The following terms and conditions apply to all transactions carried out by you on this Web Site. By accessing this Web Site and placing an order you accept these terms and conditions.
“DiamondCutCarpetsOnline” will be referred to as “dcco.com” throughout the terms and conditions.
"Consumer" means any person who is purchasing goods from ‘dcco.com’
"Goods" means all products available for purchase on our Web Site.
"We" or "us" refers to diamondcutcarpetsonline.com
This Web Site is only intended to be used and accessed in the UK. We cannot accept any orders from outside the UK.
2 PLACING AN ORDER
Upon placing all orders over our secure pay site a representative of ours will phone you within 24 hours to confirm your order and discuss delivery. Payment can be made over our secure site or by bank transfer. No goods can be dispatched until payment has been made in full
2.1 An order is placed when you either verbally request us to place your order on your behalf, email us your request or receive our confirmation email.
2.2 The date and time of the order shall be the date and time on your preferred confirmation method as stated above.
2.3 If you receive confirmation of an order that you did not place, or if the details in the confirmation do not match the order which you placed you must contact our customer services team within 12 hours by telephone or e-mail to cancel the order or correct the details.
2.4 All quotes and orders will be based upon the measurements provided by you the customer .
3 PRICE AND PAYMENT METHODS
3.1 All prices are in pounds sterling unless otherwise stated. Payment must be made in pounds sterling.
3.2 Payment by card is subject to authorisation by the card issuer. If such authorisation is refused to us, we will not be liable for any delay or non-delivery
3.3 Payment can be made in a number of ways, credit or debit card ,bank transfer or paypal , this can be debited immediately and enable us to arrange delivery within a couple of days providing stock is available.
3.4 Any omission or error in any sales literature, web page or site, order form, quotation, price list, order acknowledgement, dispatch note, invoice or other document issued by us may be corrected by us without liability.
3.5 All final prices are inclusive of VAT and delivery costs
4.1 We will do our best to supply the Goods ordered by you within our recommended delivery timescales, and in any event will give a commitment to deliver on a set date. Our timescales will be taken from the date of receipt of the deposit.
4.2 All Goods are offered subject to availability. You will be advised of any delay in delivery . If your order cannot be fulfilled, we will give you a full refund..
4.3 If your Goods are not delivered as arranged or are damaged in transit or the wrong Goods are delivered, please notify our customer services team by e-mail or by telephone within 7 days of the date of delivery.
4.4 You shall provide us and those sub-contractors whom we may use to supply the goods with full and safe access to the area where the services are to be provided.
4.5 If a driver arrives at your address and is unable to deliver on the arranged delivery date for whatever reason, you will be liable for any additional costs incurred. All deliveries must be signed for. Please inspect all goods immediately on delivery, for visible damage. If you are unfortunate enough to receive a damaged or missing item, make sure it’s noted on the courier’s paperwork.
4.6 No liability can be accepted for costs caused by late deliveries or for any other reason. Therefore we advise against booking installers until goods have been received.
5 CANCELLATIONS AND RETURNS POLICY
5.1 Although we endeavour to display correct pricing and description at all times, dcco.com reserve the right to refuse the sale of mis-priced products.
5.2 Once an order has been placed and has been cut to size by the respective manufacturer we will be unable to offer refunds whether the goods have been dispatched or not. This is in line with the Distance selling regulations at http://www.oft.gov.uk/shared_oft/distance-selling-downloads/for-customers/DSforcustomers_rightsbuying1.pdf
This relates to "the supply of goods made to the customer's own specification." We will endeavour to obtain a re-stock fee from said manufacturer which we will then pass on to the customer but in many cases these are not offered by the various manufacturers.We will attempt to obtain these on a case by case basis as they are dependant on carpet cut size and manufacturer.
5.3 All returns and cancellations must conform to the guidelines laid out in the “Distance Selling Regulation” a guide of which can be found at the office of fair trading at http://www.oft.gov.uk/
5.4 Carpets - If upon installation or delivery, carpets are believed to be faulty or damaged then we will arrange for them to be inspected by the manufacturer or a neutral inspections company and if found to be so we will repair or replace the goods where possible, or offer you compensation to keep the goods in their current condition. The time limit for making claims for faulty Goods is 3 months from the date of delivery unless the fault could not have been discovered on you undertaking a reasonable inspection of the Goods within this time period, in which case you will have 14 days from discovery of the fault.
5.5 Wood Floors-Check that the boards are flawless before laying them. dcco.com will not accept any claims for damaged, faulty or mis-described items once the wood flooring has been installed. Where the buyer has used or installed the goods such use or installation shall be taken as conclusive evidence that the buyer has accepted that the goods are in perfect condition. You must accept full responsibility for the suitability of the goods ordered for the purpose to which they are put, dcco.com uses an independent arbitrator to adjudicate all claims for manufacturer faults after installation. If you wish to proceed with an inspection dcco.com reserves the right to charge, the cost for inspection is £80.00 + VAT. If the inspection shows that the complaint is caused by a manufacturing fault said charge would be refunded,

6 DATA PROTECTION
6.1 It is our policy to take all necessary steps to ensure that all personal data that we hold about our customers is processed fairly and lawfully. We will take all necessary steps to implement this policy.
6.2 In order to process your order for Goods we shall require your name, address, address for delivery (if different) and e-mail address. We shall also require the information necessary for the payment by credit or debit card.
6.3 We do not pass on personal details of our customers to third parties save for those employees, and sub-contractors whom we may use to deliver the Goods or supply the services.
6.4 We may from time to time send promotional emails using the credentials supplied. You are able to opt out of these messages by clicking on the 'unsubscribe' links provided at the bottom of such emails.
7 FLOOR COVERING COLOURS/PATTERN MATCHING/FITTING
7.1 Before purchasing from us, we recommend viewing the product in person, either in a local shop or via a sample, as dcco.com cannot guarantee the colour/pattern matching from sample to sample. Although we endeavour to supply Goods in accordance with the colour charts shown on our Website, we cannot guarantee the products supplied will be an exact colour match to those shown. It is therefore possible that minor differences may occur which are inherent in all naturally produced products. These differences do not occur due to a fault in the manufacture of Goods. We would bring your attention to the following matters that are characteristic to carpets and other floor coverings. All carpets sold will be consistent with manufacturers recommended tolerances.
7.2 We will endeavour to colour match different carpet widths but cannot guarantee identical matches unless stated in the confirmation. Side-by-side pattern matching or consistent room to room linear design directions cannot be guaranteed.
7.3 Pile carpets, especially those with plain grounds, are liable to shading/watermarking where light and dark patches arise due to uneven surface pressure. Shading is a natural occurrence in carpets and is not a manufacturing fault and will not affect its durability.
7.4 All cut pile fabrics of any fibre type will flatten due to use, particularly in areas of heavy use. Regular vacuuming will help to allay this. Pile flattening is a normal reaction to localized traffic and is not a manufacturing defect.
7.5 Carpet seams will be present if the room or area exceeds the width of the carpet selected.

Where individual products are subject to additional warranties or guarantees given by their manufacturers, you are responsible for applying for the warranty in accordance with the manufacturer's instructions. Such warranties are not enforceable against us, but only enforceable against the manufacturer.
11. All Goods ordered will be ordered to the exact sizes as provided on the Order Form. We cannot accept any liability should any product ordered not fit due to any errors in the measurements provided.
12.We shall not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation): an act of God, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to give us a correct delivery address or notify us of any change of address.
